TERMS AND CONDITIONS

1.1 Any contract for the servicing or repair  of any product shall be with  JUSTPLASMAS  and shall be deemed to incorporate these conditions in any document or other communication used by the person requesting the servicing to be done ("the Customer"). In the event of conflict  these conditions shall prevail.

1.2 No amendment or addition to these conditions shall form part of any contract unless made or specifically agreed to be by JUSTPLASMAS in writing. Such amendments will entitle jUSTPLASMAS to adjust the price and any delivery dates appropriately.

1.3 No Service Contract shall come into existence until the Customer’s order or request for service has been accepted by JUSTPLASMAS, JUSTPLASMAS shall not be obliged to accept any such orders or requests.

2.1 Quotations/estimates are issued subject to the price and availability of the necessary components required at the time of acceptance.

2.2 Justplasmas  reserve the right to submit a revised estimate if:-

2.3 the need for additional work becomes apparent after the remedial work has commenced

2.4 the cost of any parts are subject to price amendment

2.5. work will be suspended pending the receipt of further instructions if clauses 2.3  becomes effective

2.6 When clause 2.5 applies, and the revised estimate has been refused or additional  parts are no longer available, the Customer is liable for the full payment of  the work been done.

2.7 Where an estimate has been provided and there has been no reply within 30 days we will assume the item is a refused estimate . 

3. Service and Repairs

3.1 Justplasmas agrees to use all reasonable endeavours to service or repair the Product and/or to remedy any faults on it as reported by the Customer.

3.2 The time of repair is subject to availability of the parts and may take up to 30 days. If within this period the Customer decides to cancel the repair, the Customer is  liable to pay  the full estimate or the full amount of the fixed price offer  (whatever is greater).

3.3 Justplasmas will make every effort to keep a comprehensive stock of commonly used parts. With the increasing complexity of modern goods and a vast overall range of spares, we are unable to stock all spares.

3.4 Spares that are not commonly used will therefore be drawn from the manufacturer and Justplasmas will use its best endeavours to ensure a swift delivery.  Justplasmas may request an advanced payment with orders for such spares.

3.5 Any repair is subject to availability of the necessary parts.

4. Price

4.1 The Customer shall be charged for replacement parts, labour and delivery (if applicable) at the standard rates set by Justplasmas  from time to time.

4.2 Justplasmas shall reserve the right to request a deposit against any repair which in its opinion is likely to exceed a proportion of the depreciated value of the Product.

4.3 The charges for all services provided (including the provision of estimates)  include carriage/delivery charges.

4.4 Prices are subject to alteration by Justplasmas at any time without prior notice.

5. Packaging

The specification for packaging the Product for return to the Customer after service, repair or replacement shall be entirely at the discretion of Justplasmas who shall have the right to pack the Product in such a manner, with such materials and in such quantities as Justplasmas  in it’s absolute discretion thinks fit and it shall not be obliged to comply with any packaging instructions or any requests from the Customer.

Should the Customer requests that the Product is to be collected from themselves and Justplasmas agrees to arrange for the collection of the Product, the Customer shall be entirely responsible for the correct packaging of the Goods and Justplasmas shall under no circumstances be responsible for loss or damage to the Goods due to insufficient or improper packaging nor shall Justplasmas be responsible for any other consequential loss or damage whatsoever, however arising.

7. Delivery

7.1 Unless otherwise expressly stated in writing by Justplasmas the Product shall be held at Justplasmas’s premises ,  Justplasmas shall make an arrangement to deliver the Product to an address specified by the Customer by any method of transportation at the option of Justplasmas Justplasmas  will charge for delivery at the standard rate. known as collection,, estimate delivery charge

7.2 Whilst Justplasmas will use all reasonable endeavours to keep any agreed delivery date it accepts no liability whatsoever for any loss or damage resulting from delays howsoever the same shall have been caused. 

8.1 The risk of loss or damage to the Product shall pass to Justplasmas upon delivery to Justplasmas’s premises. It shall pass from Justplasmas to the Customer upon delivery of the Product after service, repair or replacement to the address specified by the Customer or into custody on his/her behalf (whichever is sooner), whereupon the Customer shall be responsible for obtaining and paying for appropriate insurance.

8.2 Justplasmas shall not be liable for loss or damage to video tapes, audio tapes, Compact Discs or phonograph records included with the Product by the Customer or signals recorded thereon.

8.3 In the case of loss or damage (other than listed in 8.2), Justplasmas's liability is limited to the depreciated value of the Product minus the estimate for repair or £50.00 (whatever is greater). If the Product has been found to be beyond economical repair (BER), it has no depreciated value.

8.4 When calculating the depreciated value, the life expectancy of electronic equipment is taken between 4 - 7 years depending on the amount of use, the quality of the goods and the environment in which they are used.

All due payments  must be paid on or before delivery of the  Product by Justplasmas or it’s collection by the Customer.

10.1 When the Product is ready for collection or delivery Justplasmas shall contact the Customer at the address by Email or by phone specified by the Customer . The Customer shall inform Justplasmas of reasonable times during normal working hours when the Product can be delivered from Justplasmas’s premises. If the Customer does not contact Justplasmas within three months , the title to the Product shall pass to Justplasmas, who shall be free to dispose of or sell the Product. If the Product is sold, the Customer is entitled to any proceeds left over once we recovered any amount owed by the Customer plus our expenses in this process.

10.2 Where the Customer was informed that the Product is beyond economical repair or where the estimate has been refused, or if the required part (s)  are no longer available or have been discontinued the Customer shall inform Justplasmas of reasonable times during normal working hours when the Product will be delivered or collected from Justplasmas’s premises. If the Product is not deliverd or collected within one calendar month, Justplasmas may charge a storage fee at a rate of £7.00 per week in the case of plasma screens up 42 inch and £9.00 per week plasma screens over 42 inch  up 63 inch if this charge is not paid  prior to delivery the title to the Product shall pass to Justplasmas, who shall be free to dispose of the Product. The Customer will be liable for any charges for such a disposal.

11.1 Justplasmas warrants that any repair made hereunder shall be free of defect in material and workmanship for the period of ninety days after delivery or collection of the Product to the Customer . 

11.2 This warranty does not cover any other faults not previously reported by the Customer or any new faults developed during the warranty period.

11.3 This warranty excludes wear and tear, physical damage, any damage due to incorrect use or misuse and any damage due to unauthorized repair or attempt to repair.

11.4 Justplasmas does not accept any responsibility when the Product is used in adverse environment or conditions outside the specifications or if the Product has been subjected to unapproved modifications or was used in combination with other equipment with unapproved modifications.

Should the Customer requests that the Product is to be collected from themselves and Justplasmas agrees to arrange for the collection of the Product, the Customer shall be entirely responsible for the correct packaging of the Goods and Justplasmas shall under no circumstances be responsible for loss or damage to the Goods due to insufficient or improper packaging nor shall Justplasmas be responsible for any other consequential loss or damage whatsoever, however arising.
